These General Terms and Conditions of Purchase apply to the sale of all EMWEY articles through its website and to consumers who can have their orders delivered in Europe (European Union member countries only). EMWEY informs that its website is exclusively addressed to a public over 18 years old. EMWEY reserves the right to cancel a user’s access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

The use of our website and contracts for the purchase of products through this website shall be governed by Spanish law.

HOW TO BUY:

The products you wish to purchase must be selected and added to the shopping basket by clicking on the corresponding icon, where you will find the reference of the selected article, its name, size, colour and price.

The price expressed does not contain transport as the rates vary according to the country of destination. The order form will request the personal data that will be incorporated into our database in order to process the order and to facilitate further purchases at www.emwey.com.

In the same way, you will be able to access your personal data and information on all your orders. The personal data must be indicated with all accuracy to avoid incidents in the shipment of the garments or accessories purchased. Once the purchase order has been completed, and before the order is sent, we will show you a summary identifying the article purchased, its total price (transport and taxes included) and the delivery details. The order must be confirmed by clicking on the “Accept Orders” button. We will also send you an email, with a description of the order and the personal details that have been communicated. The non-reception of this message may be due to some transitory communications problem on the network or to some writing error in the communicated e-mail address. In both cases, please contact info@emwey.com.

If, at the time the order is issued, our warehouse detects that any of the products included in the order are not in stock, we will try to locate them. If this is not possible, the customer will be notified immediately. In addition, the amount of the article charged will be refunded to you.

PRICE LISTS:

All prices shown on the website for our products are without taxes. This is because the applicable taxes vary according to the country from which the purchase is made. The final purchase summary shows the final price of the purchase, indicating the amount corresponding to the applicable taxes according to the country chosen in the delivery details. On the Value Added Tax, as a general rule, the tax rate of 21% will be applied for the territory of the European Union where this tax is applicable.

When selling to any other country in the world, the customs systems of each country will apply the corresponding taxes.

Due to their special tax regime, purchases made in the Canary Islands, Ceuta and Melilla by residents of these territories are exempt from payment of VAT (all customs clearance costs and import taxes are not included in the price of the article or the shipment, and must be paid at destination by the buyer of the goods).

Prices are always in Euros and may be revised and modified at any time and without notice.

PRODUCTS ON OFFER:

The articles that we promote at a special price will be shown on the website with the following information: usual price, offer price, , percentage discount . These offers will be available for a period of time or until the end of stock, in which case the product will automatically disappear from the website.

When paying by VISA or MASTERCARD you will be asked for the following information: the card number, expiry date, and a Validation Code that coincides with the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering further guarantees regarding the security of the transaction.

Secure Electronic Commerce is a system for securing transactions on the Internet. We guarantee that every transaction made on WWW.EMWEY.COM is 100% secure. All operations involving the transmission of personal and banking data are carried out using a secure environment. All the information you transmit to us travels encrypted through the network. Your credit card details are not recorded in any database, but go directly to the POS (Point of Sale Terminal)

In addition, to provide greater security for credit card owners, we have incorporated the Secure Payment System into our payment gateway.

In this way, if you are a holder of a “SECURIZED” card, you can always pay with your VISA or MASTERCARD in our shop. When you pay by card, you will be asked for the following information: card number, expiry date, a validation code that matches the last 3 numbers printed on the back of your card and a personal key for exclusive use for Internet purchases that securely identifies you as the card’s owner. Therefore, nobody will be able to make a purchase on the Internet if they do not know this code.

The aim is to give greater security to the user who buys over the network, by “authenticating the purchaser” as the legitimate holder of the card you are using. If you have not yet received a personal password for exclusive use in Internet payments, we recommend that you ask your financial institution or bank to sign up your cards for the Secure Electronic Commerce service. To do so, contact your bank or, if you are an e-banking customer, you can request it directly online.

Up to orders of less than 500 euros we accept payments with non-secured cards.

When you make your purchases in our shop www.emwey.com and pay with VISA or MASTERCARD, in addition to the number and expiry date of your card, you will be asked for a special password for exclusive use in Internet purchases.

Go to your bank’s electronic banking service to obtain your “securised” VISA or MASTERCARD. In this way, nobody else uses your card to pay on the Internet, and it is your bank to which you provide all the information concerning your banking details.

We remind you that to make an effective purchase you must have the page configured according to the destination country of your order.

CAN I CANCEL MY ORDER?

If your order has not left our warehouse, you can cancel your order by sending an e-mail to info@emwey.com indicating the reasons for cancellation, the order number and your user name. In the subject of the e-mail put Cancellation of the order.

TRANSPORT, DELIVERY TIMES AND SHIPPING COSTS:

We pay a lot of attention to the delivery of your order and of course we can adapt to all your requirements: delivery requirements, gift delivery, exact date etc.

According to our possibilities, we will always find solutions to satisfy you. The ordered products are delivered to the address you have given us. By delivery, we mean the dispatch from our warehouse to your home of the item(s) ordered.

Our ASM couriers will not necessarily make an appointment with you for delivery.

If you are not at home at the time of delivery, the carrier will leave a transit notice in your letterbox with your contact details so that you can call them to make a new appointment.

To avoid delivery incidents (wrong addresses, not finding someone at home, etc.), it is essential to correctly fill in all the fields requested when placing the order.

Online shopping is exclusively for the countries listed in the table. Under no circumstances will deliveries be made to PO Boxes. For logistical reasons, there are certain areas of mainland Spain where home delivery is not possible. The carrier will contact the customer to provide the nearest collection point.

All online orders will be processed between 7:00 and 15:00 in the morning. Any order placed after 15:00 will be processed the next day, with the delivery time counting from this date. Once the order is served from our warehouse it cannot be modified or cancelled.

If your order is sent to the Canary Islands remember that it is necessary to indicate your ID in the comments of the order or in the additional information of your address, otherwise the delivery times could be affected.

All shipments are made through the ASM shipping agency and its corresponding partners in the delivery countries. As soon as the package leaves our warehouse you will receive an e-mail with a tracking number and you will also be notified of its status.

WHERE IS MY ORDER?

If after the delivery period has passed and you still have not received your order, you can find out its status by going to the www.asmred.como website and sending an e-mail to info@emwey.com indicating your order.

Emwey Sport S.L. reserves the right to modify the method of shipment and delivery times without prior notice due to logistics needs.

LEGISLATION AND JURISDICTION:

The present general conditions will be interpreted in accordance with the legislation in force in Spain on the subject, which will be applied subsidiarily in all that has not been foreseen in the same. (Basically Law 34/2002 of 11 July on information services and electronic commerce)

These General Conditions of Purchase and any relationship between the user and EMWEY SPORT S.LU. shall be governed by Spanish law. For any controversy that may arise from the interpretation or application of these General Conditions or from the relations between the user and EMWEY, both parties, expressly waiving any other jurisdiction that may correspond to them, submit to the jurisdiction and exclusive competence of the Courts and Tribunals of Vigo (Pontevedra), Spain.
